TERMS AND CONDITIONS Revolution Soccer Complex — Houston, Texas 1. ACCEPTANCE. By accessing or using the Facility, our services, or our digital properties (websites and apps), you agree to these Terms. Revolution Recreation LLC operates and Revolution Recreation Development, LLC owns the Facility ("Revolution," "we," "us"). 2. CHANGES. We may modify these Terms at any time; changes are effective when posted. Continued use means acceptance of the updated Terms. 3. FIELDS, WEATHER, AND BOOKINGS. Our outdoor turf fields are built for use in most conditions, including rain. Bookings are not canceled for weather unless required by government authority or unless we determine conditions are unsafe; if we close, affected bookings are rescheduled. League play and field rentals are subject to a strict no-cancellation policy. 4. PAYMENTS AND AUTHORIZATION. Payment for field rentals, league play, programs, and coaching ("Sessions") is due in full before the Session. You authorize us to charge your card on file for amounts you owe, including registration fees, balances, and authorized add-ons. You agree not to initiate a chargeback for charges you authorized; disputes are handled under Section 8. 5. CANCELLATIONS, REFUNDS, AND EXPIRATION. All sales are final and non-refundable except as expressly stated or required by law. Packages and credits expire six (6) months from purchase. Coaching may be modified or canceled only with the coach's prior consent; no-shows are charged in full. Management may make discretionary exceptions. 6. ELIGIBILITY AND ACCOUNTS. You must be 18+ to create an account and register participants. You are responsible for the accuracy of your information and for activity under your account. Minors may participate only when registered by a parent or legal guardian who signs the required waiver. 7. CONDUCT, SAFETY, AND ALCOHOL. You and your guests must follow Facility rules, the code of conduct, and staff instructions. We may deny entry or remove anyone for unsafe, abusive, intoxicated, or rule-violating behavior, without refund. Alcohol is served only to patrons 21+ with valid ID; no outside alcohol. 8. INFORMAL RESOLUTION; BINDING ARBITRATION; CLASS-ACTION WAIVER. Please first contact us at info@revolutionsoccercomplex.com to resolve any concern. If unresolved, you and Revolution agree that any dispute will be resolved by BINDING INDIVIDUAL ARBITRATION under the Federal Arbitration Act, administered by JAMS or the AAA, and that ALL DISPUTES MUST BE BROUGHT INDIVIDUALLY — YOU WAIVE ANY RIGHT TO A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION and to a jury trial, to the extent permitted by law. Either party may bring a qualifying claim in small-claims court. 9. ASSUMPTION OF RISK; LIMITATION OF LIABILITY. Participation involves risk, and use of the Facility is also governed by the Release of Liability and Waiver. The Facility and digital properties are provided "as is." To the fullest extent permitted by law, Revolution is not liable for indirect, incidental, consequential, special, or punitive damages, and our total liability for any claim is limited to the amount you paid us for the Session giving rise to the claim. 10. MEDIA AND PUSHIT. We may capture photos, video, and PushIt highlight recordings at the Facility and use them for marketing as described in the Waiver and Media Release. 11. INTELLECTUAL PROPERTY. All content on our digital properties is owned by Revolution and may not be copied or reused without written consent. 12. PRIVACY. Your use is subject to our Privacy Policy. We collect and use your information to provide services, process payments, and communicate with you; we do not sell your personal information. 13. INDEMNIFICATION. You agree to indemnify and hold Revolution harmless from claims arising from your use of the Facility or services, your violation of these Terms, or your infringement of others' rights. 14. GOVERNING LAW; VENUE. Texas law governs. Any matter not subject to arbitration will be brought exclusively in the courts of Houston (Harris County), Texas. 15. REWARDS POINTS. Revolution Rewards is a promotional program, not a payment product. (a) NO CASH VALUE. Points have no cash value, are not property, are not a stored-value or gift instrument, and are never redeemable for cash. They are a limited, revocable license to receive a discount, and confer no ownership interest. (b) WHERE THEY MAY BE USED. Points may be redeemed only at Revolution Soccer Complex, on our goods and services, at the rate we publish. They cannot be used at third-party vendors operating at the Facility, and cannot be applied to taxes, gratuities, cash prizes, or third-party fees. (c) ALCOHOL AND AGE. Points in the account of any person under 21 may not be applied to alcohol, and no person under 21 may use points to obtain alcohol for themselves or anyone else. We may refuse any redemption that would violate this or Texas law, and valid ID is required. (d) NON-TRANSFERABLE. Points belong to the account that earned them. They may not be transferred, combined across accounts, sold, bartered, or given away, and they do not pass by inheritance or in a domestic relations proceeding. (e) EXPIRATION. Points expire after twenty-four (24) consecutive months with no earning or redemption activity on the account. Any earning or redemption resets that period. Expired points are forfeited without compensation. (f) CORRECTIONS AND MISUSE. We may correct, reduce, or reverse points issued in error, and may forfeit points and close accounts where points were obtained through duplicate or fraudulent profiles, misrepresentation, or other abuse of the program. (g) ACCOUNT CLOSURE. Points are forfeited when an account is closed by you or terminated by us, and on termination of the program under (h). (h) CHANGES TO THE PROGRAM. We may change earning rates, redemption values, and program rules, or discontinue the program, at any time. We will give at least thirty (30) days' notice before discontinuing the program or materially reducing the value of already-earned points, after which unredeemed points are forfeited. 16. MISCELLANEOUS. If any provision is invalid, the rest remains in effect. These Terms, the Waiver, and the Privacy Policy are the entire agreement. Sections on arbitration, indemnity, disclaimers, and limitations survive termination. BY USING THE FACILITY OR REGISTERING, YOU ACKNOWLEDGE YOU HAVE READ, UNDERSTOOD, AND AGREE TO THESE TERMS.
